HB 2060 removes the nursing personnel from the Corrections Officer Retirement Plan (CORP) membership and requires CORP nursing personnel, employed as of the effective date of this act, to elect to transfer into the Arizona State Retirement System (ASRS) or remain in CORP. 

 

History

Currently, the designated positions that belong to CORP within the Arizona Department of Corrections (ADC) and the Arizona Department of Juvenile Corrections (AJC) are as follows:

Food service,

Nursing personnel,

Corrections physician assistant,

Therapist,

Corrections dental assistant,

Hygienist,

Corrections medical assistant,

Correctional service officer, assistant deputy warden, deputy warden, warden and superintendent,

State correctional program officer,

Parole or community supervision officer,

Investigator,

Teacher,

Institutional maintenance worker,

Youth corrections officer,

Youth program officer,

Behavioral health treatment unit manager,

Specified personnel in the director’s office of the AJC and in the superintendent’s office of the state educational system for committed youth,

Specified personnel in the director’s office of ADC, and

Positions designated by the local board of ADC and AJC.

 

 

Provisions

·                      Removes the CORP nursing personnel from the designated eligibility list within the Corrections Officer Retirement Plan (CORP).

 

·                      Requires nursing personnel, employed as of the effective date of this act, to elect to either:

1.      Remain in CORP

2.      Transfer into ASRS

 

·                     States that the election to transfer must be in writing and filed with the Fund Manager by December 31, 2001.

 

·                     Specifies that the failure to make an election to transfer means the member remains in CORP.

 

·                     Clarifies that the election to transfer is irrevocable and constitutes a waiver of all benefits provided by CORP.

 

·                     Provides for a transfer of funds language.
