As Passed the House

HB 2054 expands the classification of aggravated assault to include assaults against either a public transportation driver or passenger.

History

Under Arizona law, any one of the following actions is considered assault:

·        Intentionally, knowingly or recklessly causing any physical injury to another person;

·        Intentionally placing another person in reasonable apprehension of imminent physical injury;

·        Knowingly touching another person with the intent to injure, insult or provoke.

The law also classifies certain types of assaults as aggravated.  These are defined by statute and carry greater criminal penalties than assault.

Provisions

·                      Broadens the category of aggravated assault to include assault on a passenger of a bus, streetcar or other vehicle for hire, or an assault on an operator, employee, agent or contractor of a transportation provider who is engaged in performing any duties on any bus, streetcar or other vehicle for hire.

·                      Stipulates that such an aggravated assault is a class 6 felony.

HB 2054 was amended in the Judiciary Committee as follows:

·                      Removes language that makes assaults on a passenger of a bus, streetcar or other vehicle for hire an aggravated assault.

·                      Makes technical and conforming changes.
