HB 2053 establishes a new section in Arizona Revised Statutes (ARS), Title 28, to conform to ARS Title 4, by requiring the Arizona Department of Transportation Motor Vehicle Division (MVD) to suspend the driver’s license of a person between eighteen and twenty-one years of age if the person is found guilty of operating a motor vehicle with any spirituous liquor in their body.

 

History

HB 2053 resolves the inconsistency between ARS Title 4, section 244, paragraph 33, and ARS Title 28, section 3320, since current Title 28 statutes only allow MVD to suspend a person’s driver license for this offense if the person is under eighteen years of age

 

Provisions

·                      Requires MVD to suspend a person’s driver license for two years if the person is eighteen, nineteen, or twenty years of age, and operating a motor vehicle with any spirituous liquor in their body.

·                      Authorizes MVD to restrict the offender’s driving privilege between their home, school and place of employment during specified periods of time according to the offender’s schedule.

·                      Defines “conviction” to mean a final conviction or judgment, including an order of the juvenile court.
