HB 2043 requires that internet web sites established by the state must include a privacy statement and notice as to how information gathered by the site will be collected and used.

 

 

Provisions

·                      Provides that any web site offered by the state must contain a privacy statement that describes the information gathering and dissemination practices of the state.

 

·                      Establishes the minimum amount of information that must be provided on the web site as follows:

 

1.      The services provided by the site.

2.      Information regarding how transactions are processed by the web site.

3.      Whom will have access to the information provided by the taxpayer.

4.      Security measures provided by the site.

 

The committee on Energy Utilities and Technology adopted the following strike everything amendment:

 

·                     Establishes that state web sites must contain a privacy statement

·                     States what information the statement must contain.

·                     Provides that agency web sites must provide a privacy policy on the agency’s web page or on any page requesting or requiring the individual to provide information. 

·                     Stipulates that the policy must be clear and conspicuous.

·                     States that agencies are prohibited from sharing information gathered on line with any person or entity.

·                     Establishes that in the event that an agency requests a social security number the following information must be included:

·         The legal authority under which the information is being collected.

·         How the number will be used.

·         A statement that failure to provide a social security number may result in the denial of an application, benefit or service.

·         If there is no legal authority to collect a social security number, the individual must be informed that not providing a number will not result in a denial.

·                     Provides that individuals must have reasonable access to the information collected about them on line.

·                     States that personal information collected on line must be secure.

·                     Adds that agencies must comply with the Children’s Online Privacy Protection Act of 1998.

·                     Allows agencies to share information collected on line with law enforcement officials.
