HB 2026 replaces the term visitation with parenting time in relation to the time that non-custodial parents have with their children.

 

History

The change in terminology is a recommendation of the Domestic Relations Reform Subcommittee.  Fifteen other states have also replaced the term visitation with other conciliatory language as well.  Examples include: Montana uses terms such as parental contact, parenting plan, allocation of parenting functions and child’s residential schedule; and Minnesota has changed visitation to parenting time in all family court laws applicable to parents.

 

Provisions

·                      Replaces the term visitation with parenting time.

·                      Makes technical and conforming changes.

 

HB 2026 passed the Human Services Committee unamended.

 

HB 2026 was amended in the Rules Committee to make technical and conforming changes to related sections of statute.

 

HB 2026 was amended in the Committee of the Whole to remove a section relating to in loco parentis, and to make technical and conforming changes.
