HB2021 amends section 42-13402, which deals with property valuation, common areas and airports.

 

History

Residential subdivisions and communities often contain Acommon areas @ that are available for the exclusive use and benefit of the residents of the subdivision.  These common areas include such things as basketball courts, pools, or vacant land for parks or beautification strips available for the enjoyment of the residents. Prior to 1999 valuation of common areas was a problem for assessors as there were no statutes providing specific guidance or consistency regarding these areas. SB 1372 passed in 1999 to solve this problem by establishing guidelines for the assessor when valuing these common areas. These guidelines created a uniform standard, which valued all common areas at five hundred dollars. However some subdivisions continue to have problems with the valuation of common areas where unusual circumstances        occur, such as an airstrip.  This bill addresses those situations.

 

 

Provisions

·                      Specifies that a common area must consist of improved or unimproved real property that is for the primary use of both owners and residents of a residential subdivision. The definition is expanded to include airports.

·                      Defines an airport as runways and taxiways that are used primarily by residents of the residential subdivision but that may be designated, as a reliever airport by the federal aviation administration and that receives no public funding.

 

HB2021 as passed by the Committee on Military, Veterans’ Affairs and Aviation amended:

·        Page 1, line 8, strike PRIMARY insert “EXCLUSIVE”

·        This allows for the definition of common areas to be intended for the exclusive use of its residents.
