HB 2020 extends current exemptions for three irrigation districts.

 

History

In 1988, the Arlington Canal Company, the Buckeye Water Conservation and Drainage District and the St. John’s Irrigation District were exempted from:

1.      Irrigation water duties;

2.      Conservation requirements imposed by the first, second and third management periods for the Phoenix Active Management Area (AMA);

3.      Groundwater withdrawal fees. 

A water duty exemption fee of 25 cents for each irrigated acre per year was imposed.  The exemptions expire in 2009.

 

Current law requires the Director of the Department of Water Resources (DWR) to review the hydrologic conditions in the exempted area and to submit recommendations to the Governor, the Speaker of the House and the President of the Senate by December 15, 2005 regarding the exemptions.

 

Provisions

·                      HB 2020 extends the exemption from the groundwater withdrawal fee for ten years, from 2009 to 2019, exempts the districts from the provisions of the fourth management period and extends the due date for the DWR Director’s recommendation regarding the exemptions from 2005 to 2015.

 

HB 2020 was amended in the NRA Committee as follows:

·              Changes the due date of the DWR Director’s recommendation relating to the exemptions from 2017 to 2015.

 

The Natural Resources & Agriculture Committee amendment was adopted in Committee of the Whole.
