HB 2018 prohibits discrimination of owners or operators of a motorcycle, or people wearing clothing associated with motorcycle ownership or operation.
Arizona statute currently prohibits the discrimination of persons based on race, color, creed, national origin or ancestry.
· Prohibits discrimination of people who own or operate a motorcycle, or wear clothing associated with motorcycle ownership or operation.
· Allows a public accommodation to refuse access or admission on the basis of conduct that poses a safety risk or a posted dress code that is in effect that does not exclude a particular individual or group of individuals associated with motorcycles.
· Allows a court to enjoin a violation of equal access guarantee to the persons described in the section.
· Allows a person injured by a violation of equal access to bring a cause of action for injunctive relief or damages.
· Allows for actual damages incurred and limits punitive damages to $5,000 against the offending public accommodation.
