House Bill 2006 provides that a person who operates or is in actual physical control of a vehicle with a Blood Alcohol Content (BAC) of 0.15 or greater is guilty of driving under the extreme influence of intoxicating liquor.  Current statute prescribes a BAC of 0.18 or greater before a person is guilty of extreme DUI.

 

History

Laws 1998, Chapter 302 (Loper’s Law) established a separate violation for driving under the extreme influence of intoxicating liquor by specifying that a person who operates or is in actual physical control of a vehicle with a Blood Alcohol Content (BAC) of 0.18 or greater is guilty of extreme DUI.

 

Provisions

·                      Provides that a person who operates or is in actual physical control of a vehicle with a Blood Alcohol Content (BAC) of 0.15 or greater is guilty of driving while under the extreme influence of intoxicating liquor.

·                      Makes a technical and conforming change.
