HOUSE OF REPRESENTATIVES AMENDMENTS TO H.B. 2402

Strike everything after the enacting clause and insert:

"Section 1.  Title 36, chapter 34, Arizona Revised Statutes, is amended by adding Article 4, to read:

ARTICLE 4.  MENTAL HEALTH INFORMATION CENTER

36-3451  Mental health information center; clearinghouse; purpose

A.  tHE dIRECTOR of the department of health services SHALL ESTABLISH A clearinghouse to gather INFORMATION NECESSARY TO FACILITATE AND PROVIDE UP-TO-DATE data relating to mental health services testing, evaluation procedures and treatment protocols to ensure that public monies are used only for mental health services that have been documented to be safe, effective, valid and reliable. tHE director shall designate the clearinghouse as THE mENTAL hEALTH iNFORMATION cENTER.

B.  tHE mENTAL HEALTH INFORMATION CENTER SHALL BE located AT THE uNIVERSITY OF aRIZONA TO PERMIT MULTIDISCIPLINARY COOPERATION AND PARTICIPATION IN DEVELOPING THE clearinghouse.

C.  A committee composed of the president of the UNIVERSITY of arizona, the dean of the college of medicine at the University of ARizona and the dean of the department of psychology at the university of arizona shall select a RESEARCHER to be the head of the mental health information center.  The committee shall forward the name of the person it selects to the director who shall forward the name to the governor, the president of the senate and the speaker of the house of representatives.

d.  tHE MENTAL HEALTH INFORMATION CENTER SHALL:

1.  establish a web site to allow access to its database by all interested parties, including governmental and private entities and the general public.

2.  evaluate all mental health testing, evaluation procedures and treatment protocols to determine:

(a)  if they are effective, valid and reliable.

(b)  their scientific limitations.

(c)  alternatives, including less expensive alternatives.

(d)  if they comply with scientific standards established by the united states supreme court.

3.  provide a brief history of the mental health services tests, evaluation procedures and treatment protocols.

4.  gather normative data.

e.  The center shall maintain all information in standard and understandable english.

F.  The center shall make information in its database available to the public at all times.

g.  The center is not limited in the sources of information from which it may obtain information and data.

H.  on request from a member of the public or a governmental or private entity, the center shall evaluate a new and innovative test, EVALUATION procedure or treatment protocol by using the standards prescribed in subsection d, paragraph 2.  The center shall submit a written report of its findings to the person or entity that made the request AND shall ENTER ITS FINDINGS IN THE DATABAse.

I.  before a state agency payS for a mental health test, EVALUATION or treatment, the person who is responsible for AUTHORIZING the payment MAY submit sufficient INFORMATION on the mental health service to the center to allow the center to evaluate the service using the standards prescribed in subsection d, paragraph 2."
