AN ACT
ESTABLISHING THE SCHOOL BREAKFAST INCENTIVE AND MARKETING PROGRAM; MAKING AN APPROPRIATION.

Be it enacted by the Legislature of the State of Arizona:
Section 1. School breakfast incentive and marketing program
A. The department of education shall establish a two year school breakfast incentive and marketing program.
B. In fiscal years 2001-2002 and 2002-2003 the department of education shall reimburse school districts that participate in the federal school breakfast program from monies appropriated by this act up to an additional ten cents per meal for each child who participates in the school breakfast program. Reimbursement is contingent on continued federal reimbursement to schools for the school breakfast program at a per meal rate that at least equals the rate in effect during the 2000-2001 school year.
C. In fiscal years 2001-2002 and 2002-2003, the department of education shall conduct a comprehensive marketing and information campaign to notify pupils and families of the availability, eligibility requirements and application requirements of the federal school breakfast program. The marketing and information campaign shall also educate pupils and families about the benefits of proper nutrition for school-age pupils. The marketing and information campaign shall be funded with monies appropriated pursuant to this act.
D. During the 2001-2002 and 2002-2003 school years, the department of education shall compile a report on school participation in the federal school breakfast program. Schools in which thirty-five per cent or more of total enrollment has been qualified as eligible for the federal free or reduced price school lunch program but that do not offer the school breakfast program must report their reasons for nonparticipation to the department of education.
E. By October 31, 2002 and October 31, 2003 the department of education shall issue a report to the governor, the speaker of the house of representatives, the president of the senate and the members of the joint legislative committee on hunger and shall transmit a copy of this report to the director of the Arizona state library, archives and public records and the secretary of state. The report shall include all of the following:
1. Data on the participation rates of schools and pupils in the federal school breakfast program.
2. A summary of the reasons why schools choose not to offer the school breakfast program, as reported by schools.
3. Recommendations as to the continuation, expansion or discontinuance of the school breakfast incentive and marketing program, including any recommendations that are designed to increase school participation in the federal school breakfast program.
Sec. 2. Appropriations; purpose
A. The sum of $2,400,000 is appropriated from the state general fund in fiscal year 2001-2002 to the department of education to carry out the purposes of this act. Of the monies appropriated pursuant to this subsection, up to ten per cent may be used to fund the marketing and information campaign prescribed in section 1, subsection C of this act and the report prescribed in section 1, subsection D of this act.

Of the monies appropriated pursuant to this subsection, up to ten per cent may be used to fund the marketing and information campaign prescribed in section 1, subsection C of this act and the report prescribed in section 1, subsection D of this act.
Sec. 3. Delayed repeal
This act is repealed on January 1, 2004.
