delinquent registration; title; penalty waiver

 

Purpose

 

Exempts automotive recyclers from delinquent registration penalties related to a motor vehicle upon applying for a dismantle certificate for the vehicle.

 

Background

 

Current statute imposes a penalty fee if an application for registration and/or title is not completed and returned within thirty days of the date the title was signed to the new owner.  The penalty is eight dollars for the first month and four dollars per month for each month after that, up to a maximum of $100.  If the new owner of the vehicle then resigns the vehicle over to a new owner before registering and paying the penalties, the person in possession of the vehicle is then responsible for the fine. 

 

Currently, statute requires anyone selling a vehicle for destruction or dismantling to sign the title of the vehicle over to the purchaser.  When the purchaser then applies for a dismantling permit, they must show the signed certificate of title.  The automotive recycler is exempt from obtaining a dismantle certificate if the automobile had previously been issued a dismantle certificate, a salvage title, or nonrepairable vehicle certificate of title.   

 

In 1993, the motor vehicle division established a policy to exempt individuals seeking a dismantle certificate of title from any delinquent penalties due on the automobile.  This policy applies to all individuals, not just automobile recyclers.  This legislation codifies this policy in statute.  

 

There is no fiscal impact to the general fund associated with this bill.

 

Provisions

 

1.      Requires the Arizona Department of Transportation to waive all penalties that are associated with a vehicle when an automotive recycler is applying for a dismantle certificate of title.

 

2.      Provides for a general effective date.
