Purpose
Provides guidelines and requirements relating to the
posting of public meeting notices on web sites.
Background
Arizona’s open meeting law requires all meetings of
any public body to be public meetings and access for all persons who wish to
attend. Statute further requires the
public bodies of the state, counties, municipalities, school districts and
other special districts to provide notice of public meetings and to file
statements with the Secretary of State, the clerk of the board of supervisors,
the city clerk or the mayor’s office that indicate where all public notices of
their meetings will be posted. In addition,
these entities are required to give such additional public notice of all
meetings as is reasonable and practicable.
H.B. 2003 addresses the impact of web sites and the internet on open
meeting laws.
H.B. 2003 poses a potential fiscal impact to the Secretary
of State in collecting and compiling a master list of the web site addresses of
public bodies.
Provisions
1. Requires the Secretary of State to maintain a web site master list for public access to all public notice lists including web site addresses, statements and available meeting notices provided by public bodies.
2. Allows a public body with an established web site to post public notice of a meeting on the web site.
3. Requires public bodies with an established web site to include the web site address on statements filed with the Secretary of State, the clerk of the board of supervisors, the city clerk or the mayor’s office indicating where public notice is posted.
4. Requires the maintenance of a listing of public notice locations on any functioning web site established by the filing office.
5. Makes technical changes.
6. Provides for a general effective date.
