FACT SHEET FOR S.B. 1341

school districts; early retirees

Purpose

Allows an early retiree or the spouse of an early retiree of a school district to hold membership on a governing board of that school district.

Background

Current statute requires that each school district have a governing body composed of governing board members, and, among other eligibility requirements, a board member is prohibited from being an employee or the spouse of an employee of that school district.

There are currently no statutory definitions clarifying the eligibility of early retirees or their spouses serving on a governing board of a school district.

S.B. 1341 specifies that early retirees or their spouses are eligible to hold membership on a governing board of that school district.

There is no positive fiscal impact associated with this bill.

Provisions

1.      Allows an early retiree or the spouse of an early retiree from a school district to hold membership on a governing board of that school district.

2.      Makes a technical change.

3.      Provides for a general effective date.
