Purpose

 

Allows some misdemeanor probationers to possess firearms.

 

Background

 

Current statute prohibits anyone serving probation or on parole for an offense from possessing firearms.  Possession of a firearm by a prohibited possessor is a class four felony (presumptive 2 ½ years in prison and potential $150,000 fine plus 77 percent surcharges).

 

There is no fiscal impact to the state general fund.

 

Provisions

 

1.      Allows those on probation for a misdemeanor to possess a firearm unless the offense was domestic violence, assault or a related offense.

 

2.      Makes technical changes.

 

3.      Provides for a general effective date.

 

Amendments Adopted by Committee of the Whole

 

1.      Prohibits those on probation for  assault or related offenses or domestic violence from possessing firearms.
