Purpose

 

Allows some misdemeanor probationers to possess firearms.

 

Background

 

Current statute prohibits anyone serving probation or parole for an offense from possessing firearms.  Possession of a firearm by a prohibited possessor is a class four felony (presumptive 2 ½ years in prison and maximum $150,000 fine plus 77 percent in surcharges).

 

There is no fiscal impact to the state general fund.

 

Provisions

 

1.      Allows those on probation for a misdemeanor to possess a firearm unless the offense was domestic violence.

 

2.      Makes technical changes.

 

3.      Provides for a general effective date.

 

Amendments Adopted by Committee of the Whole

 

1.      Prohibits those on probation for  assault or related offenses or domestic violence from possessing firearms.

 

Amendments Adopted by the House of Representatives

 

1.      Removes prohibition of firearms possession for those convicted of a misdemeanor assault or a related offense.
