Purpose

 

Eliminates the restriction that those on misdemeanor probation may not possess firearms.

 

Background

 

Current statute prohibits anyone serving probation or on parole for an offense from possessing weapons.  Possession of a weapon by a prohibited possessor is a class four felony.

 

There is no fiscal impact to the state general fund.

 

Provisions

 

1.      Eliminates the restriction that those on misdemeanor probation may not possess firearms.

 

2.      Makes technical changes.

 

3.      Provides for a general effective date.
