SB 1338 removes language that terminates community property rights upon the entry of the decree of legal separation.

 

History

Laws 1998, Chapter 280 terminated community property rights when a decree of dissolution of marriage, legal separation or annulment is filed.  However, the 1998 legislation inadvertently retained conflicting language relating to the termination of community property rights upon the entry of a decree for legal separation. The proposed legislation eliminates the conflicting language.

 

Provisions

·        Strikes language relating to the termination of community property rights upon the entry of a decree of legal separation.

 

·        Makes technical changes.

 

SB 1338 passed out of the Judiciary Committee unamended.
