SB 1334 requires the Arizona Department of Transportation (ADOT), in consultation with the State Board of Transportation (STB), to develop a 20-year transportation plan and allows ADOT to procure rights-of way for projects specified in the plan.

 

History

Current statute (A.R.S. 28-6951) requires ADOT to develop a five-year transportation facilities construction program according to policies established by the STB and requires the appointment of a departmental committee to prioritize transportation projects, annually prepare and update a long-range transportation construction program, review changes and their priorities within the program, and document its recommendations in a written report.

 

A 1997 performance audit conducted by the Office of the Auditor General (OAG) made four recommendations relative to ADOT’s transportation planning process: (1) ADOT should adopt a method that makes greater use of data and criteria for making programming decisions; (2) ADOT should continue its efforts to expand the involvement of its district engineers, regional planning groups and the public; (3) ADOT should continue its efforts to create a detailed long-range plan that includes an accurate long-term financial forecast and listing of needed projects; (4) ADOT should better link short-range programming decisions  to long range priorities by explicitly considering long-term priorities when developing the five-year plan.

 

Laws 1989, Chapter 222, authorized ADOT to acquire right-of-way and obligate state funds up to ten years prior to the estimated construction completion date.

Provisions:

·                      Requires ADOT to develop a 20-years transportation facilities construction plan in consultation with the STB on or before July 1, 2003.

·                      Specifies that the 20 year plan shall:

·                      Detail estimated engineering, right-of-way and construction costs;

·                      Describe each project, location and priority;

·                      List and group projects by priority and beginning date;

·                      Be compatible with local general and county comprehensive plans;

·                      Include updating procedures and guidelines for the 20-year plan.

·                      Allows ADOT to purchase rights-of-way for projects in the 20-year plan.

 

SB 1334 passed the Transportation Committee unamended.

 

SB 1334 was amended in Committee of the Whole as follows:

·                      States that if a plaintiff that causes a condemnation act to be dismissed before the payment of damages awarded to the defendant, the plaintiff shall not initiate any eminent domain proceeding with respect to the same property for the same or any related project for at least two years after the judgment.
