SB 1331 is an emergency measure that revises school board and taxing district filing deadlines to coincide with nomination petition deadlines and it changes the filing date for recognition of new political parties.

 

History

In order to allow county records sufficient time to deal with potential court challenges, Laws 1999, Chapter 224 revised deadlines for nomination petitions for a variety of primary elections, and it was found that certain candidates for offices only requiring nominating petitions for the general election are not included.  Additionally, the earlier filing date for candidates to appear on the ballot occurs prior to the filing date for recognition of a new political party.  The petition for recognition of a new political party can not be filed prior to 105 days before the primary election but must be filed not less than 75 days prior to the primary.

 

Provisions

·                      Changes the nomination petition filing deadlines to 15 days before the current deadline for fire district boards, school boards, multi-county water conservation districts, groundwater replenishment districts, and active management area water districts.

·                      Changes the period political parties have to file for continuing and new recognition on ballots to 65 days before the current deadline as well as eliminates the limit on how early the petition may be filed.

·                      Changes the deadline for petition submission to the county recorders or municipal clerks for signature verification to 68 days before the current deadline.

·                      Allows new political parties that are seeking recognition on both the county and state levels to file the original petition for recognition with the County Elections Officer and a certified copy of the petition with the Secretary of State.

·                      Changes the period for determining entitlement of political parties seeking continued recognition on a ballot to 30 days before the current deadline.

·                      Changes the period for which a city or town clerk has to determine which political parties qualify for the general election to 35 days before the current deadline.

·                      Make technical and conforming changes.

·                      Contains an emergency clause.
