SB 1310 expands and clarifies the powers and duties of fire districts.

History

In Arizona, fire districts provide fire and emergency medical services in unincorporated areas of the state. The powers and duties of fire districts as outlined in ARS Section 48-805, are accomplished through a board or elected chief and a secretary-treasurer.

Provisions

· Requires a fire district to determine the compensation payable to district personnel. Currently, a fire district can only determine compensation payable to fire fighters for time spent in training and for fire protection services.

· Allows a fire district to employ personnel and provide services for the carrying out of other powers and duties. Current law specifies that fire districts may employ personnel deemed necessary for fire protection and preservation of life.

· Allows a fire district to assist the state fire marshal in the enforcement of the uniform fire code when expressly authorized by the state fire marshal. Currently, the law allows a fire district to assist the state fire marshal in the enforcement of state fire protection standards within the fire district.

· Allows a fire district to establish fee schedules for fire protection services and services for the preservation of life. These services include emergency fire and emergency medical services, plan reviews, standby charges, fire cause determination, users’ fees, facilities benefit assessments or any other fee schedule that may be required. Current law limits a district to establishing fees for services provided to non-residents and non-taxpayers.

SB 1310 passed the Rural and Native American Affairs Committee unamended.
