SB 1307 stipulates that a person with criminal negligence who discharges a firearm within or into the limits of a municipality is guilty of a class six felony.

 

History

Currently it is a class two misdemeanor to discharge a firearm within the limits of any municipality.

 

Provisions

·                      Stipulates that a person with criminal negligence who discharges a firearm within or into the limits of a municipality is guilty of a class six felony.

·                     States that if the dangerous nature of the discharge can not be proven, the offender will be charged with a class 1 misdemeanor.

·                     Exempts a person who discharges the firearm more than one mile from any occupied structure or persons who act in self defense or in the defense of another person against an animal attack.

·                      Defines municipality as any city or town and includes any property that is fully enclosed within the city or town.

·                      Contains an emergency clause.

·                      Designates this act as Shannon’s Law.
