HB 2488 changes the sunset review cycle from ten to five years.
The sunset review process was established by Laws 1978, Chapter 210, to review the purpose and functions of state agencies to determine whether the agency should be terminated, continued, or modified. Currently, the review process is on a 10-year cycle, in which each new agency is given 10 years before it is reviewed. The audit is performed by the Office of the Auditor General (OAG) or a Committee of Reference (COR), which is a subcommittee made up of House and Senate members. If the COR does the audit, there are questions set forth in statute that the agency must answer as a self-audit. A public hearing is also conducted, where testimony regarding the audit is taken from the public or agency staff. Following the audit, the OAG or COR must present a report that includes a recommendation to continue, revise, consolidate or terminate that agency.
