HB 2486 provides for the privatization and expansion of the Apache prison facility and transfers monies from an existing appropriation.

 

History

Laws 1992, 8th Special Session, Chapter 2, Section 7 provided for the construction of the Apache prison facility with approximately 250 beds and appropriated $1.5 million to do so.  However, due to design efficiency, the Apache prison facility began with an operating capacity of 334 beds.  Currently, the Apache prison facility has 343 inmates.

 

Provisions

·                      Requires the Arizona Department of Administration (ADOA) to issue a request for proposals (RFP) for both the operation and expansion of the Apache prison facility.  The RFPs must include private operation of the facility no earlier than July 1, 2002, and no later than December 31, 2002.

·                      Requires the department of corrections to enter into a contract for the private operation and expansion of up to four hundred beds, after JLBC reviews ADOA’s findings and determines it would be cost effective for the state to privatize and expand the Apache prison facility.

·                      Transfers $300,000 from the appropriation made to ADOA by Laws 1996, Chapter 337, section 6 in order to execute provisions of this bill.  Exempts the reappropriation from lapsing, except monies remaining unencumbered and unexpended on June 30, 2002 revert to the corrections fund.
