HB 2005 creates a separate civil penalty for persons operating a vehicle carrying fewer than two persons in a high occupancy vehicle (HOV) lane.  The bill also establishes an unmarked law enforcement vehicle fund.  

 

History

Currently, persons violating HOV lane restrictions are cited under section 28-644, “failure to yield to a traffic control device.”  Persons found responsible for violating this section are subject to a civil penalty not to exceed $250.  In accordance with section 28-1554, civil penalties for current HOV lane violations collected by the municipal or justice courts are retained by and inure to the city, town, or state in which the court is located.

Provisions

·                      Creates a civil penalty of $250 for any person operating a vehicle in a HOV lane carrying less than two persons, including the driver, when a lane is restricted to vehicles with less than two persons.

·                      Establishes an unmarked law enforcement vehicle fund, administered by the Director of the Department of Public Safety.  Monies in the fund, as appropriated by the legislature, shall be used to purchase unmarked law enforcement vehicles.
