firearms regulation; state preemption

Purpose

Prohibits the political subdivisions of this state from enacting ordinances relating to firearms and ammunition.

Background

Current statute prohibits the political subdivisions of this state from enacting any ordinances that conflict with state law relating to the transportation, possession, carrying, sale and use of firearms.

Proponents of this bill report that this act will ensure that gun regulations throughout the state are uniform so that individuals can travel from city to city and not worry about violating different ordinances. Opponents of the bill feel that state law is ambiguous in some areas of gun regulation and cities, therefore, need to have the ability to enact clarifying ordinances that do not conflict with state statute.

H.B. 2615 has no discernable fiscal impact.

Provisions

1. Prohibits political subdivisions from enacting any ordinance relating to the transportation, possession, carrying, sale and use of firearms or ammunition.


2. States the intent of the Legislature is to clarify existing law relating to the state's preemption of firearms regulation in the state and that it is to apply to actions or appeals pending on the effective date.


3. Contains a technical change.


4. Contains a general effective date.
