Purpose

Allows a non-custodial family member to enroll a pupil in a school district in which the non-custodial family member resides.

Background

Children who reside with a family member other than a parent or legal guardian may experience a delay in school admission as statute does not currently address the enrollment of a pupil by a non-custodial family member to a school district in which the non-custodial family member resides. It may take from four to six weeks for a non-custodial family member to be granted custody of a pupil which can delay pupil enrollment into a school district where a non-custodial family member resides.

H.B. 2614 allows a non-custodial family member to enroll a pupil in a school district in which the non-custodial family member resides during the process of seeking legal guardianship or custody of the pupil.

Provisions

1. Allows a non-custodial family member to enroll a pupil in a school district in which the non-custodial family member resides, upon written documentation that the non-custodial family member is attempting to obtain legal guardianship or custody of the pupil.


2. Requires a non-custodial family member to provide to the school district, within 30 days of a pupil's enrollment, written documentation stating the attempt to obtain legal guardianship or custody of the pupil.


3. Requires a non-custodial family member to provide documentation to a school district upon obtaining legal guardianship or custody of a pupil.


4. Makes a technical change.


5. Contains a general effective date.
