House Bill 2626 provides that a person is guilty of extreme driving under the influence if a person is operating or in actual physical control of a vehicle with a Blood Alcohol Content (BAC) of 0.15 or greater.

History

Laws 1998, Chapter 302 (Loper's Law) established a separate violation for extreme driving under the influence (EDUI) by specifying that a person operating or in actual physical control of a vehicle with a BAC of 0.18 or greater is guilty of EDUI. Chapter 302 also created a pilot program that allows the courts to restrict a person's driving privilege by ordering the installation of an ignition interlock device in motor vehicles operated by an extreme DUI offender.
