Abstract for HB 2618 (insurance fraud) Sponsor: Marsh


Amends Title 13 and Title 20 statutes relating to insurance fraud.

PROVISIONS:

Increases the penalty for unlawful solicitation of a tort victim from a Class 1 misdemeanor (6 months, $2,500 fine) to a Class 6 felony (1 year, $150,000).

Prohibits the use of a "runner ," "capper " or "steerer" for any purpose. Currently, runners, cappers or steerers may not be used in the commission of fraudulent practices relating to incomplete or untrue statements of material fact regarding insurance.

Eliminates the requirement that a person violate §20-463 "with intent to injure, defraud or deceive an insurer" to commit a Class 6 felony.
