AN ACT
AMENDING LAWS 1997, FIRST SPECIAL SESSION, CHAPTER 7, SECTION 18, AS AMENDED BY LAWS 1997, SECOND SPECIAL SESSION, CHAPTER 2, SECTION 10 AND LAWS 1998, CHAPTER 214, SECTION 23; PROVIDING FOR CONTINUED REIMBURSEMENT OF ARIZONA HEALTH CARE COST CONTAINMENT SYSTEM CLAIMS.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Laws 1997, first special session, chapter 7, section 18, as amended by Laws 1997, second special session, chapter 2, section 10 and Laws 1998, chapter 214, section 23, is amended to read:

Sec. 18. Supplemental appropriation; payment of claims

The sum of $3,274,000 is appropriated to the Arizona health care cost containment system from the state general fund in fiscal year 1996-1997 in the amount of $1,231,000 for Apache county and $2,043,000 for Navajo county for payment of claims outstanding against Navajo and Apache counties for fiscal years 1994-1995, 1995-1996, 1996-1997, 1997-1998 , and 1998-1999 AND 1999-2000 for tribal members who reside on Indian reservations and who received health care services off-reservation in a private or public non-Indian health services facility or health care provider's office. Notwithstanding title 11, chapter 2, article 7, Arizona Revised Statutes, Apache and Navajo counties shall submit the fiscal years 1994-1995, 1995-1996, 1996-1997, 1997-1998 , and 1998-1999 AND 1999-2000 claims to the Arizona health care cost containment system administration which shall review the claims and pay the providers pursuant to the administration's reimbursement methodologies established in title 36, chapter 29, article 1, Arizona Revised Statutes. After payment of valid outstanding fiscal years 1994-1995, 1995-1996, 1996-1997, 1997-1998 , and 1998-1999 AND 1999-2000 claims, the administration shall return to the state general fund any unexpended monies due to, but not limited to, duplicate claims, and other health care coverage including Title XIX coverage that can be used to pay an outstanding claim. This appropriation is exempt from the provisions related OF SECTION 35-190, ARIZONA REVISED STATUTES, RELATING to lapsing OF APPROPRIATIONS , except that any monies remaining as of June 30, 2000, 2001 revert to the state general fund.
